Georgia legislators call for homeowner input on HOA reform measures

State Representatives Viola Davis, Kim Schofield, and Sandra Scott are calling on Georgia homeowners to participate in upcoming legislative discussions about Homeowner Associations (HOAs), Property Owner Associations (POAs), and Condominium Associations. The lawmakers are encouraging residents to share their experiences at a Senate Urban Affairs Committee meeting scheduled for Thursday, September 18, 2025, at the Coverdell Legislative Office Building in Atlanta.

The representatives also pointed to a recent Senate Rules Subcommittee on Homeowners Associations meeting held on Tuesday, September 16, which addressed legislation related to POAs. They urged Georgians to attend future meetings focused on these issues.

“Too many Georgians have been stripped of their rights by unregulated HOAs,” said Rep. Davis. “This week’s hearings are about transparency, accountability and protecting the American Dream of homeownership. We need homeowners to show up, share their stories and help us fight back.”

“There is not a week that goes by that I don’t hear from families harmed by HOA abuse,” said Rep. Schofield. “We need comprehensive reform, and we need homeowners to be engaged. Together, we can make change happen.”

“No one should lose their home over abusive fees or unfair practices,” added Rep. Scott. “We are standing shoulder-to-shoulder with homeowners to demand fairness. These hearings are the people’s chance to be heard.”

The three representatives outlined several proposed bills as part of their Housing & Transparency Package for 2025–2026:

– The Community Association Transparency & Protection Act would establish an ombudsman and provide stronger protections for homeowners.
– The Homeowner & Community Association Accountability Act proposes creating a division within state government to investigate complaints and enforce fair practices.
– The Homeowner Ombudsman & Dispute Resolution Act would offer mediation services under the Attorney General’s office.
– Additional acts would raise foreclosure thresholds, ban insider deals within associations, require fair dispute resolution processes, guarantee access to financial records for homeowners, ensure public disclosure in property assessments, end abusive foreclosures for unpaid fees by HOAs, create eviction diversion programs for tenants facing removal from housing units, expand solar energy access while supporting green jobs locally.
– House Bill 62 aims to strengthen transparency in condominium and homeowner associations through clear rules regarding board operations and annual registration requirements.
– House Bill 712 seeks greater clarity by requiring counties and cities not add non-tax-related charges such as stormwater or solid waste fees onto property tax bills.

Residents were encouraged by the lawmakers both to testify at committee hearings if possible and support legislative reforms designed to protect homeowner rights.

Burns has served as a Republican representative in Georgia’s State House since his election in 2005 after succeeding Ray Holland.
